1. Scope of Application

These General Terms & Conditions (GT&Cs) define the legal relationship between The Zurich Insider (referred to as "TZI," "we," or "our"), the customer, and any third parties booking Services on behalf of customers.

These GT&Cs apply to all services ("Services") offered by TZI, as detailed on our website or through our official social media accounts.
1.1 Terminology

Service(s): Refers to all trips, tours, and other services provided by TZI.

Content: Refers to TZI’s trademarks, media (pictures, videos, blogs), texts, brochures, and any other materials presented on our platforms.

Customer(s)/You: Refers to our guests, travelers, participants, clients, and website visitors.
1.2 Acceptance

By accessing or using our Services, you confirm acceptance of these GT&Cs as binding.

2. Eligibility & Terms of Participation
2.1 Age Requirements

You must be at least 18 years old to join our Services. Participants under 18 must be accompanied by an adult who can represent them.
2.2 Restrictions

Participation in a Service while under the influence of drugs, medication, or excessive alcohol is strictly prohibited. For the safety and enjoyment of all, we require compliance with these GT&Cs and any guidance provided by TZI staff or experience guides.
2.3 Exclusions

TZI reserves the right to exclude any participant from a Service due to health concerns, non-compliance with these terms, or disregard of team instructions.
Note: No refunds will be issued in cases of exclusion. TZI is not liable for damages resulting from such exclusion.
2.4 Pets

If you wish to bring a pet, please inform us when booking. We will do our best to accommodate your furry friend whenever possible.
2.5 Customer Responsibilities

You agree to:

Adhere to all local laws.

Respect customs and cultures.

Assess your physical and mental readiness for the Service.

Respect others' privacy.

Cooperate with guide instructions.

Interact with fellow participants and staff with respect and courtesy.

In other words, Clients are expected to behave respectfully and considerately toward guides, fellow travelers, and local residents throughout the Service.
TZI reserves the right to remove any client from a Service, without refund, if they engage in behavior that is deemed disruptive, discriminatory, or otherwise disrespectful to others or the local culture.
3. Your Health
3.1 Responsibility

While your well-being is our priority, you are responsible for your own physical and mental safety throughout the Service.
3.2 Health Disclosure

By making a deposit or payment, you confirm that you are in good health and have no (visible or invisible) conditions (physical, mental, or emotional) that may pose risks to yourself or others during the Service.

While we strive to accommodate all clients, please note that some Services may not be accessible for individuals with specific mobility or accessibility needs. We are committed to making accommodations where possible but require full disclosure to ensure your safety and comfort.

3.3 Non-Disclosure

Failure to disclose relevant health information may result in TZI canceling your booking. In such cases, cancellation charges, as outlined in Section 7, apply. TZI is not responsible for any resulting costs.
3.4 Risk Assumption

All Services carry some level of risk. By participating, you assume these risks and, to the fullest extent permitted by law, release TZI and its employees from liability for any claims, losses, or expenses.

Including, but not limited to, those resulting from personal injury, property loss, or accidental incidents.
3.5 Health Compliance Measures

Clients agree to comply with all local health regulations, including vaccinations or testing requirements, if applicable, and acknowledge that failure to comply may result in exclusion from certain parts of the Service without refund.
4. Health, Travel & Cancellation
4.1 Insurance Recommendations

Before traveling, review your personal insurance to ensure adequate coverage for potential losses, illnesses, cancellations, delays, or other unforeseen events.
Note: We strongly encourage customers to verify that their insurance covers the specific activities involved in their Service.
4.2 Travel and Cancellation Insurance

We recommend obtaining travel and cancellation insurance for the entire trip duration to protect against unexpected circumstances that may lead to cancellations or modifications.
4.3 TZI’s Insurance Policy
-
TZI does not provide health, travel, or cancellation insurance. For added peace of mind, we offer an optional "No-Question-Asked" Cancellation Assurance
4.4 Flexibility and Limitations
-
Although TZI’s GT&Cs and Cancellation Policy are flexible, they cannot account for every potential situation. We advise securing comprehensive insurance coverage.
4.5 Travel Documents and Entry Requirements
-
Clients are responsible for ensuring they meet all passports (e.g. validity, etc.), visa, and entry requirements for each destination. TZI cannot be held liable for any denied entry or additional costs due to non-compliance with these requirements.
5. Prices, Bookings, Planning Fees, Deposits & Payments
5.1 Price Quotes
-
Each Service’s price (referred to as the "Service Price") is quoted in Swiss Francs (CHF) unless otherwise specified.
-
Service Prices include all listed inclusions and 8.1% VAT.
-
Prices may change, as detailed in Section 7.
5.2 Booking Process
-
Bookings can be made through our website, affiliated travel agencies, hotels, tourist information centers, or directly via phone or email.
-
Completing a booking signifies that you and any third-party booking on your behalf agree to these GT&Cs as binding.
Note: TZI does not accept non-binding reservations.
5.3 Payment Terms
For Services booked within 30 days of the Service date
-
Full payment is due at booking, and the booking is confirmed only upon receipt of the total payment.
For Services booked more than 30 days in advance
-
A 20% deposit is due at the time of booking to secure your reservation.
-
The remaining balance is due no later than 30 days prior to the Service date. Failure to pay by the due date will result in the booking being voided.
5.4 Consultation Fee & Deposit
-
For exclusive, highly personalized Services, we require a CHF 690.00 consultation fee, which includes CHF 350.00 for consultation and CHF 340.00 as a deposit.
-
This fee covers our expertise, initial consultation, and research for your custom itinerary.
Note: The consultation fee is non-refundable. However, if you book the Service with us, CHF 340.00 will be credited toward the final payment.
5.5 Payment Methods

We accept major credit cards, bank transfers, and TWINT payments. Customers are responsible for any additional costs, such as credit card surcharges or bank fees.
5.6 Late Fees for Overdue Payments
-
Any overdue balance will incur a CHF 50.00 late fee per month until settled.
6. Gift Certificates
6.1 Validity
-
Gift Certificates are valid for one (1) year from the purchase date and are not-extendable.

The certificate holder or purchaser may schedule the Service by contacting us via e-mail at hello@thezurichinsider.com and providing the Gift Certificate number.
6.2 Rescheduling
-
If you need to cancel a Service booked with a Gift Certificate at least 16 days before the scheduled date, you may reschedule within the same calendar year at no additional cost, pending availability.
-
Rescheduling to the following calendar year or additional rescheduled requests incur an administration fee of CHF 150.00.

6.3 Transferability

Gift Certificates are personal but can be transferred to another individual if you notify us at least one week before the scheduled Service.

Any associated costs, including outstanding balances, must be settled before the transfer.
6.4 Non-Refundable & Non-Redeemable for Cash

Gift Certificates are non-refundable and cannot be redeemed for cash.

The resale of Gift Certificates is prohibited.
6.5 Restrictions

Gift Certificates may not be combined with other vouchers, promotions, or offers.

Upon request, we can send the Gift Certificate directly to the recipient or to the purchaser.
6.6 Lost or Stolen Certificates

Please note that lost or stolen Gift Certificates cannot be replaced or refunded.

TZI is not liable for incidents, costs, or issues arising from third-party Services, including those that may not meet our standards of care.

15. Limitation of Liability

15.2 Participation at Your Own Risk

You participate in all activities at your own risk. TZI’s liability is limited to the Service Price and to direct damages caused intentionally or by gross negligence. TZI assumes no liability for slight negligence, consequential damages, or lost profits.
15.3 Customer Contractual Compliance

TZI does not assume any liability in cases of non-fulfillment of contractual obligations resulting from omissions or contract violations by the Customer, particularly in cases of non-compliance with the Terms of Participation outlined in Section 2.
15.4 Responsibility for Personal Property

TZI is not liable for the loss, theft, or damage of personal items, cash, valuables, luggage, photographic equipment, or misuse of checks and credit cards during the Service.
15.5 Refunds for Service Cancellations by TZI

In cases where TZI cancels a Service and no alternative is provided, our liability is limited to refunding the Service Price, as detailed in the Cancellation Policy.
16. Exclusion of Liability for Third-Party Services, Force Majeure, and customer Responsibility
6.1 Third-Party Services

TZI does not assume liability for any services provided by third-party providers.

When TZI acts as an agent for these services, or if you independently arrange activities, any resulting liabilities remain solely with the third-party provider.
16.2 Force Majeure

TZI is not liable for any disruptions or changes caused by force majeure events (e.g., natural disasters, extreme weather, government restrictions).

We will make every effort to adjust your Service accordingly, but we are not responsible for any resulting damages or costs.
16.3 Customer Responsibility

Customers participate at their own risk and must exercise personal responsibility for their physical readiness and health.

Customers are responsible for adequate personal equipment (e.g., clothing, footwear, sun protection) appropriate for the Service’s activities and conditions.

TZI does not cover claims for personal injury, property loss, or accidents due to customer negligence.

Any independently arranged travel elements, such as accommodations or flights, are the responsibility of the customer. TZI is not liable for any costs, delays, or inconveniences related to independent arrangements

TZI assumes no responsibility for loss, theft, or damage to personal items, such as cash, valuables, or luggage, during the Service.
16.5 Compliance with Local Regulations

All customers must comply with local laws and regulations. TZI assumes no liability for issues arising from non-compliance with local regulations or customs.

TZI collects essential personal data (name, contact information, date of birth, nationality, payment details) solely to fulfill contractual obligations and coordinate your Service.

Certain information may be shared with third-party providers directly involved in your booking.

In the unlikely event of a dispute that cannot be resolved amicably, you agree to submit the matter to binding arbitration through the Swiss Arbitration Association (SAA) under the Swiss Rules of International Arbitration. The arbitration will take place in Zurich, Switzerland, with proceedings conducted in English.

Both parties agree that the arbitration decision is final and cannot be appealed, ensuring a prompt and conclusive resolution.
21.3 Limitation on Claims

Any award or judgment by the arbitrator will be binding and limited to a refund of any payment made to TZI for the specific Service in question. Additional damages, whether punitive, consequential, or otherwise, are not permitted.
21.4 Waiver of Rights

TZI’s failure to enforce any right or provision in these GT&Cs does not constitute a waiver of those rights. If any provision is deemed unenforceable, the remaining terms will continue in effect.

22. Amendments
TZI reserves the right to modify or update these GT&Cs at any time. Any revisions will be effective upon posting on our website or notifying customers directly. By continuing to use our Services after changes take effect, you agree to be bound by the updated terms.
If you do not agree with the revised GT&Cs, please discontinue the use of our Services.
